Maintenance Charges In Maharashtra Are Applicable As Per Area Of A Flat

Maharashtra is one of the big states in India that constitutes a major population. Every year migrants land up to different places for a brimming future both in professional and personal life.

When a buyer wants to buy a flat then there are certain things that needs to considered like the location, size, needs, budget and the future. Every property would need maintenance to keep it updated and upgraded.

There is a sense of relief to thousands of home owners across Maharashtra, the Commissioner and Registrar of Co-operative Societies, Pune as under the jurisdiction of the Maharashtra Apartment Ownership Act, 1970, it has been ordered that the maintenance charges for a housing unit shall be calculated according to the unit area of the flat for sale.

For the comfort and convenience of the residents, the Commissioner and Registrar of Co-operative Societies, Pune, has directed that maintenance charges for housing units in the State falling under the ambit of the Maharashtra Apartment Ownership Act, 1970, will be assessed as per the unit’s area.

However, this order does not apply to flats registered under the Cooperative Societies Act, 1960. In Maharashtra the residential buildings are under the control of either the Apartment Ownership Act or the Cooperative Societies Act.

This command will benefit approximately all the houses that are in the State and registered under the Apartment Ownership Act. Over 1.2 lakh cooperative housing societies present in Maharashtra will not be able to take advantage of the order.

Prior to this rule came into force, under the Apartment Act, a resident had to pay maintenance according to the percentage of ownership in proportion to the common areas of the property for sale and then pay per sq ft.

But, now the home owner will only pay the maintenance as per the area of flat giving a sense of aid to buyers. In cooperative societies, the land and building are owned by the respective society and not individuals. Most of the maintenance charges are divided equally amongst all members, irrespective of the area of a housing unit. The components of the charges are according to the model bye-laws of cooperative housing societies.

These maintenance charges are a mandate for everyone to pay to maintain the premises and overall project for sale. Before this rule, the buyers were burdened to pay extra as they were charged for common areas. But now, they are contented because they are going to pay only for the area they are actually going to use in a flat.
